The list below indicates the legal status of the death penalty in each of the 50 states and the District of Columbia since the United States Supreme Court’s decision in 1972 to declare death penalty statues of that era unconstitutional. The list indicates years prior to 1972 in cases of abolition. Notation of years for the legality of execution does not indicate executions were carried out in each of those years, but simply that it was legal in a particular state to do so. Red indicates a state where the death penalty is currently legal. Gray indicates a state where the death penalty has been abolished, with post-1972 dates listed as a range marking the start and end dates for the legal use of the death penalty in those states.
